Division of Workers' Compensation that pays benefits to injured workers when
there is an illegally uninsured employer.

Q. What determines the employer�s rate for premium? What can I do to bring it
down?
A. A number of factors go to into determining the annual premium that your
insurance carrier will charge. These include: your industry classification; your
company's past history of work related injuries (known as your experience
modification), your payroll; any special underwriting adjustments, such as use
of a certified Health Care Organization; and any special group or dividend
programs that you may be eligible for. Further information and advice on how to
lower your rates can be found in the employer's guide, which can be ordered or

result in a civil penalty of up to $7,000 per violation. Contact your insurer to
get the posting notice and the required information that must be included on it.
Q. How do I get proof of coverage?
A. You should request a certificate of insurance from your insurance carrier.
Frivolous Lawsuits - Part 1On September 14, in yet another effort to address the problems of our litigious society, the House passed HR 4571, the Lawsuit Abuse Reduction Act (LARA), which cracks down on frivolous lawsuits by implementing sanctions against personal injury lawyers who file meritless claims. The bill penalizes individuals and their lawyers for bringing a frivolous lawsuit to court. It prevents �forum-shopping,� a practice in which lawyers try to file certain cases in states that are more likely to be sympathetic to their lawsuit. LARA requires that personal injury cases be brought only where the plaintiff resides, where the plaintiff was allegedly injured, or where the defendant�s principal place of business is located. The legislation also includes a �3 strikes and you�re out� provision, which mandates a 1-year suspension of a lawyer�s license to practice in any federal court after he or she files 3 or more frivolous lawsuits in the same federal court. HR 4571 is an important piece of legislation because current rules against frivolous lawsuits are ineffective. The right to sue has not only been exploited by lawyers, it�s been turned into one of the most destructive business models in the American economy. Personal injury lawyers today can gamble on taking cases on a contingency fee basis because they need only win 1 in 10 to score the big judgment that will make up for the losses in other cases. And we all live with the consequences, which include higher taxes and insurance rates, lack of discipline in our schools, and doctors going out of business, thus limiting Americans� access to health care. Even Good Samaritans are told to hit the road. When one man routinely cleared a trail after snowstorms, the county had to ask him to stop. The supervisor of district operations wrote, �If a person falls, you are more liable than if you had never plowed at all. Crazy world. Unfortunately, the times we are in allow for a much more litigious environment than common sense would dictate.� Scenarios such as these, and the countless others that raise the ire of individuals with common sense, are what motivated my colleagues and I to pass HR 4571. As a result, once again, the ball is in the Senate�s court, bringing us back to the question: will the Senate pass it, or drop it?
Injury Resolution Act of 2004- Part 4The legislation retains the bipartisan agreement on medical criteria that was approved by a unanimous vote in the Judiciary Committee. These criteria form the basis of a no-fault victims compensation fund that will stop the flow of resources to the unimpaired and ensure that the truly ill will be paid quickly and fairly. S. 2290 also contains improvements made to its predecessor, S. 1125, that have been developed over the last several months during extensive negotiations by the stakeholders. S. 2290 includes a number of new provisions that ensure the Fund will be set up, processing and paying claims quickly. First, it places the office within the Department of Labor in order to utilize its existing infrastructure and experienced personnel to facilitate a faster startup. In order to allow the office to begin accepting and processing claims in short order, the legislation requires the enactment of interim regulations and procedures within 90 days after date of enactment, including the expedited processing of exigent claims. To avoid potential delays associated with the appointment process, the legislation grants interim authority to an existing Assistant Secretary of the Department of Labor until the new Administrator is appointed. To ensure that adequate initial funding will be available to meet demand, the bill provides for upfront funding from Fund participants, as well as increased borrowing authority. These new provisions address concerns that claimants must have speedy access to the Fund while halting the admittedly broken tort system that continues to divert scarce resources away from the sick to the unimpaired. S. 2290 also includes revised funding provisions. It establishes a Fund that can pay $114 billion in claims, with an additional $10 billion in contingent funding available from defendant companies. Money required to go to the Fund from defendants and insurers is assured over a period of 27 years. Defendant participants, for example, guarantee their funding obligations through a grant of authority to the Administrator to impose a surcharge in any year where monies received fall short of the annual requirements. In addition, S. 2290 provides up to $300 million annually in hardship and inequity adjustments that may be granted by the Administrator among defendant participants. Money from insurers is front-loaded for the early years of the Fund where the most stress on the system is anticipated. Enforcement provisions have been strengthened to help the Administrator go after recalcitrant participants. Additional safeguards to insure the funding have also been added, such as establishing a priority for payment obligations to the Fund in State insurance receivership proceedings. "
